These terms and conditions govern the end-user customer’s (the “Customer”) use of Mahjong365.com (the “Website”) provided by MJ Solutions Limited – Registration No. 000048381, 9 Barrack Road, Belize City.
The Customer should read these terms and conditions carefully as they affect their rights and liabilities under the law. If the Customer does not agree with these terms and conditions, they should not register for or use Mahjong365.com. If the Customer has any questions about these terms and conditions, they should contact [email protected].
2. APPLICABILITY OF THESE TERMS AND CONDITIONS
The service is provided to the Customer for their personal, non-commercial use subject to these terms and conditions. By registering on the Website and/or continuing to use the website, the Customer agrees to be bound by these terms and conditions. If there is any inconsistency between these terms and conditions and any document incorporated by reference, these terms and conditions will prevail.
3. AMENDMENTS TO THESE TERMS AND CONDITIONS
3.1
The Operator reserves the right to amend these terms and conditions (including to rectify errors or mistakes discovered on the website). However, the Operator will ensure that any significant changes to these terms and conditions are notified to the Customer by an appropriate method (for example, via a prominent notice on the Website). The changes will apply to the use of the website after the Operator has given notice. If the Customer does not wish to accept the new terms and conditions, they should not continue to use the website. If the Customer continues to use the website after the date on which the change comes into effect, the Customer’s use of the website will be confirmation of their agreement to be bound by the new terms and conditions.
3.2
It remains the Customer’s responsibility to periodically check these terms and conditions to ensure they continue to agree with them, and the Customer is advised to do so each time they use the website. The Customer’s continued use of the website will be confirmation of their acceptance of any changes to these terms and conditions. Any bet received (but not settled) prior to the time of amendment and notification of the amended terms and conditions will be subject to the pre-existing terms and conditions.
4. REGISTRATION AND USE OF THE CUSTOMER’S ACCOUNT
4.1
To register for an account to use the wesbite (an “Account”), the Customer must be at least eighteen years of age. The Customer must ensure that the details provided by them on registration (or at any time thereafter) are correct and complete and must inform the Operator immediately of any changes to their details by updating their Account in order that the Operator can communicate with them effectively. The Operator reserves the right to request identification documents (e.g., passport or identity cards) for verification purposes.
4.2
When the Customer registers their Account on the Website, they will be asked to create a login and password (which will be in encrypted form and not accessible by the Operator). In order to prevent fraud, the Customer must keep this password confidential and not disclose it or share it with anyone. If the Customer knows or suspects that someone else knows their password or that any other personal information has been stolen or otherwise accessed without their authority, they should notify the Operator immediately by contacting [email protected].
4.3
If the Operator has reason to believe that there is likely to be a breach of security or misuse of the website, it may require the Customer to change their password or may suspend the Customer’s Account.
4.4
The use of artificial intelligence or “bots” on the website is strictly forbidden. Likewise, any application that uses any or all of the data contained on the website for purposes (including but not limited to commercial purposes) other than participating in the website (e.g., via screen scraping) is prohibited. The Operator will take measures to prevent and detect the use of programs that are designed to enable artificial intelligence (non-humans) to utilise or benefit from the data contained on the Website. Any attempted or actual use of artificial intelligence by the Customer will lead to termination of their Account.
4.13
The Customer can cancel their Account at any time by informing the Operator in writing at [email protected]. If the Customer does so, they must stop using the website.
4.14
The suspension or cancellation of the Customer’s Account will not affect either party’s statutory rights or liabilities.
4.15
The Customer may open only one Account. Any additional accounts that may be closed.
5. LICENCE
5.1
The Operator grants the Customer a personal, non-exclusive, non-transferable and revocable licence to install and use the software required for the use of the website (the “Software”). The Customer may use the Software solely to participate in the website.
5.2
All pictures, graphics, photographs, animations, videos, music, audio, text and live feeds on the Website and the Software are and will remain the property of the Operator and are protected by intellectual property laws, including copyright. They may not be reproduced without the Operator’s prior written consent.
5.3
Except as permitted by these terms and conditions, the Customer may not copy, use, modify, create derivative works from or distribute the Software or written materials associated with the website, decode, reverse engineer, disassemble, decompile or otherwise translate or convert the Software or any part of it or transfer, loan, lease, assign, rent or otherwise sublicense the Software or do any of the above to any copy, adaptation, transcription or merged portion of the Software. Without limitation, the above activity includes any form of denting, hacking, manipulating, attacking or damaging of the website.
6. SPECIAL RULES FOR SPECIFIC GAMES
6.1
In addition to accepting these Terms and Conditions, you acknowledge and agree to be bound by the “House Rules” and “Game Rules” which are posted on www.mahjong365.com and amended from time to time by us. In addition, you must comply with “table rules” as set out by us from time to time.
Players are asked to refrain from “table talk” or “coffee-housing” or talking during a hand in a way that compromises an opponent’s hand. This applies whether you are playing in the hand or watching the hand. Repeated abuse of this aspect of player behaviour will result in suspension or permanent restriction of play.
Abusive or offensive language or other behaviour considered inappropriate by Mahjong365 in the context of the product will not be tolerated.
Bad behaviour or offensive language identified by Mahjong365 or brought to its attention will be dealt with swiftly and may result in a suspension or loss of playing privileges or such other action as may be decided by us.
It is your responsibility to read and understand the rules of each Game. You acknowledge and agree to abide by the rules of each of the Games as published and periodically changed on our site. Such rules referenced herein are incorporated hereto and form part of these Terms and Conditions.
7. THE CUSTOMER’S REPRESENTATIONS
7.1
The Customer represents, warrants, and certifies that they fully accept that all computer instructions and responses sent over the Internet to and from the website and the Software will be binding on the Customer.
8 NO WARRANTY
8.1
The Operator will endeavour to provide the website using reasonable skill and care. The Operator makes no further warranty or representation, whether express or implied, in relation to the website. Any implied warranties or conditions relating to satisfactory quality, fitness for purpose, completeness, or accuracy are hereby excluded.
8.2
The Operator makes no warranty that the website will meet the Customer’s requirements or will be uninterrupted, timely, secure, or error-free; that defects will be corrected; or that the website or the server that makes it available is free of viruses or bugs. Nor does the Operator make any warranty as to the full functionality, accuracy, reliability of the materials supplied, or the results, or the accuracy of any information obtained through the website.
8.3
The Customer should be aware that the quality of internet connections to the website varies from customer to customer and may not be absolutely stable.
8.4
The Operator carries out regular maintenance on the website to ensure, as much as possible, that an optimum experience is provided. During such maintenance sessions, the Customer acknowledges and agrees that access to the website may be limited to allow for necessary repairs, maintenance, or the introduction of new features. The Operator will make reasonable efforts to notify Customers of such downtime in advance (via scheduled notifications or notices on the website) and resume the service as soon as reasonably possible.
9. LIMITATION OF LIABILITY
9.1
The Customer agrees that their use of the website is at their sole risk.
9.2
The Operator will not be liable in contract, tort, negligence, or otherwise for any loss or damage arising from or in connection with the Customer’s use of the website, whether direct or indirect.
9.3
The Operator will not be liable for any loss of content or data transmitted through the website. The Customer confirms that the Operator will not be liable for any website modification, suspension, or discontinuance.
9.4
The Operator reserves the right to withdraw the website or parts of it at any time and will not be liable for such action.
9.5
The Operator is not responsible for breaches of these terms and conditions caused by events beyond its reasonable control.
9.6
The Operator is not liable for any use of the website that violates local laws. It is the Customer’s responsibility to ensure legal compliance before accessing or using the service.
10. TRANSFER
The Customer may not transfer any of their rights under these terms and conditions to another person. The Operator may transfer its rights under these terms and conditions to another business if the Operator reasonably believes that the Customer’s rights will not be affected.
11. THIRD PARTY CONTENT
11.1
The website may include content from other internet sites or resources (“Third Party Content”). While the Operator takes reasonable steps to ensure that material included is accurate and reputable, it does not guarantee or warrant the accuracy or quality of such content. The Operator will not be held liable for any inaccuracies or issues arising from Third Party Content. If inaccuracies are identified, the Operator will attempt to correct them as soon as possible.
11.2
The Operator makes no representations or warranties regarding any third-party websites linked to the website (“Linked Sites”), including their operators or the content displayed. The Operator is not liable for any direct or indirect losses or damages the Customer may suffer from accessing Linked Sites. The Customer accesses such sites at their own risk.
12. THIRD PARTY RIGHTS
Except where expressly stated, these terms and conditions do not grant rights to any third party to enforce any provision of these terms and conditions under any applicable local law.
13. SETTLEMENT OF DISPUTES
The Customer understands and agrees that (without prejudice to other rights and remedies, including referral to a designated dispute resolution process) the Operator’s records and final management decisions will be the final authority in determining the terms of the Customer’s participation in the website, the activities resulting therefrom, and the circumstances in which they occurred.
14. NOTICES
If the Customer has any dispute regarding the outcome of a game or any related activity, they must submit their complaint to the Operator in writing within fourteen (14) days of the incident by emailing [email protected].
Any notice from the Operator to the Customer (unless otherwise specified) will be sent to the email address provided during account registration. It is the Customer’s responsibility to notify the Operator of any changes to this address by writing to [email protected] and to regularly check their email account for communications from the Operator.
15. GENERAL
15.1
If any part of these terms and conditions is found to be unlawful, void, or unenforceable for any reason, that provision will be deemed severable from the rest and will not affect the validity of the remaining provisions.
15.2
The timestamp on all records is recorded in Greenwich Mean Time (GMT +0).
15.3
No waiver of any provision of these terms and conditions shall be construed as a waiver of any preceding or subsequent breach of any provision.
15.4
Unless expressly stated otherwise, nothing in these terms and conditions shall create or confer any rights or benefits to any person other than the Customer and the Operator.
15.5
Nothing in these terms and conditions shall be construed as creating any agency, partnership, or joint venture between the Customer and the Operator.
15.6
The Operator may update these terms and conditions from time to time for legal, regulatory, or operational reasons.
15.6
These terms and conditions, as published in English, constitute the governing version. Translations into other languages are provided as a service and are made in good faith. In the event of any ambiguity or conflict, the English version shall prevail.
15.7
These terms and conditions represent the entire agreement between the Customer and the Operator regarding Mahjong365. The Customer confirms that they have not relied on any representation other than those expressly included herein. This clause does not limit liability for fraudulent misrepresentation.
